Obtaining a Program Electronic Review Management (PERM) labor certification is a necessary component for obtaining employment-based visas and green cards. This certification, awarded by the U.S. Department of Labor, must be submitted with any work-based visa or green card petition.
To obtain this certification, the employer must demonstrate that the job in question is a permanent, full-time position with reasonable job requirements. The position must be compensated at the prevailing wage or the actual wage the employer pays to others in this position.
The employer must also demonstrate that hiring a foreign worker for the position will not have any negative impact on the local job market or average wages.
