Employer Visa Compliance
Employers who sponsor foreign employees for an H-1B or another type of work visa must comply with all government regulations and requirements. Non-compliance can lead to significant fines, sanctions, and legal liability.
Compliance requirements come primarily from the U.S. Department of Labor and the United States Citizenship and Immigration Services (USCIS), although other compliance issues may apply to your particular situation.

PERM Labor Certification
Obtaining a Program Electronic Review Management (PERM) labor certification is a necessary component for obtaining employment-based visas and green cards. This certification, awarded by the U.S. Department of Labor, must be submitted with any work-based visa or green card petition.
To obtain this certification, the employer must demonstrate that the job in question is a permanent, full-time position with reasonable job requirements. The position must be compensated at the prevailing wage or the actual wage the employer pays to others in this position.
The employer must also demonstrate that hiring a foreign worker for the position will not have any negative impact on the local job market or average wages.
Other requirements may be necessary for you to obtain approval. Our immigration attorney can assist you in obtaining your PERM labor certification. Contact us today to learn more.
