The visa waiver program allows citizens of specific countries to come to the United States for a limited purpose. The 38 designated countries include Andorra, Australia, Austria, Belgium, Brunei, Chile, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Iceland, Ireland, Italy, Japan, Latvia, Liechtenstein, Lithuania, Luxembourg, Malta, Monaco, Netherlands, New Zealand, Norway, Portugal, San Marino, Singapore, Slovakia, South Korea, Spain, Sweden, Switzerland, Taiwan, united kingdom. Individuals from these countries complete an ESTA form before flying to the U.S. If admitted, they can stay up to 90 days. With limited exceptions, individuals under this program cannot change or adjust their status to another visa.
I am looking to travel to the United States for business. What visa do I need?
If you are traveling to the United States for business for a short period, you may be eligible for a B-1 visa. There is a list of specific business activities permitted to be performed under the B-1 visa. Such activities include, but are not limited to, negotiating contracts, consulting with business associates, etc. You will bear the burden of proving that you have a valid reason to visit the United States to engage in lawful business activity for a specific duration of time. You will also bear the burden of proving that you have significant ties to your home country, that the U.S. company will not pay you, and that you intend to return after concluding your business. We advise our corporate clients that if they bring an employee over on this visa, they should provide housing, transportation, and a limited per-diem to cover food and other incidentals. Documentation supporting these accommodations should be sent to the employee.
I want to come to the U.S. to visit. What visa should I apply for?
B-2 visitor visas are non-immigrant visas for persons traveling to the United States temporarily for tourism, pleasure, or visiting. You can apply to ETSA under the visa waiver program. Alternatively, you can apply for a visitor visa at the U.S. consulate with jurisdiction over your location. If you come under ETSA, you can be in the U.S. for up to 90 days. You cannot change your status to another visa. Non-citizens who enter on a visitor visa issued at the consulate can generally remain in the U.S. for up to 6 months. You are not allowed to work or attend school.
