In part one of this two-part series, we looked at some of the basic definitions and differences between immigration visas and someone’s overall immigration status. These are two different terms that comprise different things — visas are actually just one piece of the overall immigration status picture, and knowing how both these areas work is important if you’re involved in this realm.

Expiration

A visa allows a person to enter the United States on a certain status. The main ways your status might be changed is if you file an application to extend your visa or change your status to a different category. Your status could also change if you violate the terms of your status (for example, if you overstay your visa without filing for an amendment or extension or if you work without authorization. Your status could also change when you file for any other temporary visa  or permanent green card.

Areas of Concern

Visas and immigration status can also differ in the specific areas of concern they address. For example, a visa is only going to be concerned with your entry into the country. Once you’re actually living here, other things come into play that aren’t addressed on your visa.

On the other hand, your immigration status is going to be more concerned with you maintaining your visa in the United States. In other words, whether you follow the United States’ immigration rules on living and working the our country.

Changing Status

One area where these two terms are definitely connected is when someone is looking to change their immigration status. This sort of event will typically require an application for a new visa. It’s important to remember that you can’t just change your status on your own — you’ll need to go through the proper channels and have all the correct documentation in order. Trying to do this sort of thing on your own can lead to serious consequences, so it’s always best to seek out professional assistance.
